FMCSA Clearinghouse: What Fleet Operators Must Do

The FMCSA Drug and Alcohol Clearinghouse became mandatory January 6, 2020. Every motor carrier must comply. Here's what's required:

Before Every Hire

Query the Clearinghouse for all CDL applicants. A driver with an unresolved violation cannot perform safety-sensitive functions — period.

Annual for Current Drivers

Run a limited query on every CDL employee at least once per year. Even drivers who haven't tested positive must be queried.

Report Violations in 3 Days

Positive results, refusals, and actual knowledge violations must be reported within 3 business days of MRO or BAT notification.

SAP Completion Tracking

Drivers who tested positive must complete SAP evaluation and follow-up testing. Their return-to-duty status must be confirmed in the Clearinghouse.

⏱ Post-Accident: Time Is Everything

FMCSA post-accident tests are time-limited. Missing the window means the test cannot be used — and a missed post-accident test counts the same as a positive result.

Do I need a TPA for my random testing program? +
A TPA (Third-Party Administrator) is not legally required, but highly recommended for any fleet with 5+ drivers. TPAs manage your random pool, ensure proper selection rates, handle Clearinghouse reporting, and keep your records compliant during FMCSA audits. I'm an owner-operator — does DOT testing apply to me? +
Yes, with a nuance. If you're an owner-operator leased to a motor carrier, that carrier is responsible for including you in their testing program. If you operate under your own USDOT number, you must join a consortium random testing pool through a C/TPA. You cannot self-administer your own random testing program.
California legalized marijuana — can my CDL driver use it? +
No. State marijuana laws have no bearing on federal DOT drug testing. CDL drivers in safety-sensitive functions are subject to federal law (49 CFR Part 40), which prohibits marijuana use regardless of California state law, medical marijuana authorizations, or CBD product use. A positive THC result is a DOT violation, period.
